Welcome to HHG Digital Clinic. Hellenic Healthcare Group (HHG) is the biggest private group of provision of medical services, owning top hospitals, diagnostic centers and a medical logistics company. HHG Digital Clinic ("Digital Clinic" or "Service") provides mobile health services. The service is a mobile health service that provides technologies of instant messaging with a healthcare professional and the ability to book service appointments. In the following terms and conditions, we will use the term “Consultation” to describe an instant chat or appointment with a healthcare professional. You will always be consulted by licensed health care professionals (hereinafter referred to as “Health Care Professional”). Every Healthcare Professional has a profile on the Service, so you know in advance who you are dealing with. IT IS CLARIFIED THAT IN NO EVENT SHALL THE SERVICE BE INTENDED TO BE USED IN A MEDICAL EMERGENCY OR IN AN EMERGENCY OR IN CASE OF CRONIC DISEASES. IF YOU DOUBT THAT YOU HAVE A MEDICAL OR MENTAL EMERGENCY, CALL IMMEDIATELY FOR THE LOCATION IN THE COUNTRY WHERE YOU ARE OR NEAR AN EMERGENCY. In Greece, the emergency number is 112.

The service is intended for consulting a healthcare professional and assessing the need for care remotely. During the consultation, Healthcare Professionals will evaluate your treatment needs and will decide according to their scientific knowledge and their experience if they can give you treatment guidelines. You agree to contact your attending physician immediately if your condition changes or your symptoms persist or worsen.

These General Terms and Conditions (the “Terms”) constitute the legally binding terms that apply to the use of the Service by you. The Terms apply to all services provided by the HHG Service and / or Healthcare Professionals through the Service. Please note that the Terms constitute the agreement between you (“you” or “the user”) and HHG, which governs your rights and obligations when using the Service. **It is important that you read and understand these Terms.** By registering for the Service, clicking "**I Accept**" or similar button, installing or logging in to the Service, or otherwise using the Service, you acknowledge and confirm that you have read and understood these Terms and all documents referred to in the Terms, including the register descriptions. You acknowledge and agree that the Service handles personal information, sensitive health and patient information about you and that you consent to its processing as described in the Privacy Statements. You agree that you are bound by these Terms and our Privacy Statement. You represent and warrant that you have legal capacity to accept and abide by these Terms and Conditions and that you have read and understood the Terms in their entirety and that you have no reduced understanding of such matters as mental illness, intoxication, medication or any health or other condition that could impair your understanding. Your use of the Service constitutes acceptance of the Terms. Do not use, install or open the Service or register as a user of the Service unless you accept or understand these Terms. If acceptance of these Terms is required before or after the installation of the software or Application in connection with the Service, and you do not accept these Terms, you are not entitled to use the software or Application in question. Please be kind and delete the software or Application in question and any copies immediately in such circumstances.

We may modify or change the Terms from time to time. In these situations, we ask you to accept the updated terms. If the acceptance of the renewed terms is not fulfilled, the use of the service ceases. Registration

Use of the Service requires registration and continued compliance with the Terms. In order to register, you need to fill your name, your surname and your unique AMKA and VAT number. You must be at least 18 years old to register and use the Service. This service is for your personal use only. You represent and warrant that you will use the Service in accordance with all applicable rules and laws.

Use of the Service is prohibited in any country or region where use of the Service is illegal. You agree not to use the Service in any such country or territory.

You agree not to provide inaccurate or misleading information in connection with your use of the Service. If the information you provide to us later becomes incorrect or misleading, you will immediately notify us of any such change.

We have the right to refuse registration for any reason. Registration may be limited, for example, to the area.

Consultations, pricing, fees

Use of the service is subject to a charge. A valid price list will always be displayed at the time of purchase or otherwise on the Service. Pricing may change from time to time.

The exact duration of the Consultation may vary and you are not entitled to a refund for any unused time or payment you made for the Consultation, even if the Consultation is shorter than stated in the Service. You will not be charged if your connection fails or is terminated prematurely. If the Service is booked, queuing is free of charge. If the Service allows you to use the Service without time limit at a fixed price, you agree that HHG may, however, impose reasonable restrictions on your use of the Service.

By using the Service, you agree to pay all fees associated with your use of the Service, as defined at the time of purchase immediately after the use of the Service. The fee is pending till the completion of the service. In case the service is not provided, the committed amount will be released. You also agree to be charged using the payment method available on the Service (the “Payment Method”). You agree that any billing errors or errors that may occur may be corrected, even if a payment has already been requested or received. Payment Terms are based on the Payment Method and may be governed by the contractual terms between you and your financial institution, credit card Company, or other Payment Method Provider. The Payment Method is provided by a payment processing provider that follows applicable law in facilitating payment transactions. “Applicable Law” means applicable European Union (“EU”) laws and regulations relating to the privacy, confidentiality, security and protection of Personal Data and the Payment Card Industry (“PCI”) Data Security Standards.

For the use of the present service, STRIPE is responsible for the payment that is taking place. The receipt that is issued will be sent electronically to your email by STRIPE.

You agree that the Service will begin electronically with your consent immediately upon commencement of the Consultation and that you are not entitled to cancel your subscription. Please note that access to the Service required access to the Internet for which your carrier may charge you additional charges. You will be responsible for the cost of your communications, hardware and software.

Patient information and confidentiality

In this application, the Consultation, when completed by the Doctor, produces a summary that includes whatever is necessary according to the doctor’s knowledge and experience such as the diagnosis, the prescription and the medication. This summary as well as the conversations and chats created equalize to the patient records. Patient records are created, stored, disclosed and kept confidential in accordance with applicable laws and regulations.. Data Controller of these information, according to the General Data Protection Regulation is the Hygeia Diagnostic and Therapeutic Centre S.A.. It is mentioned that according to the Greek legislation, medical archives are maintained by the Data Controller for a duration of (twenty) 20 years.

Intellectual Property Rights

These Terms give you the right to use the Service only for the duration of these Terms and do not confer ownership of the Service. All intellectual property and other rights, including all copyrights, patents and trade secrets, of the Service, including the Site and the Application, remain with HHG Digital Clinic. You may not copy, save, reproduce, modify or assign the Service or any portion thereof. However, the User has the right to store individual information about himself in accordance with the purpose of the Service and these Terms.

Services provided by third parties

The Service may also provide information about or links to third-party services. HHG shall not be liable for such third party services or for any information, acts or omissions therein.

Prohibited activity

The list below contains examples of prohibited activities on the Service:

- Impersonation;
- Unlawful or illegal use of the Service;
- Transmission of any information, material, content or information that is offensive, degrading, obscene, counterfeit, forfeit, infringing, or otherwise illegal;
- transmitting or posting any virus, malware or other malicious code to the Service;
- Modify, reverse engineer, or otherwise manipulate the Service;
- Harassing or disabling the Service.

To ensure the inviolability of the Service, we reserve the right, at any time and without cause, to prevent users from accessing the Service.

You are responsible for all indirect and consequential damages, including for third parties, which may result from your use of the Service in violation of the law, these Terms or any good practice. Each user is responsible for claims against HHG service, HHG employees, or self-employed persons, and for any damage resulting from their actions or omissions.

Privacy and security

Proper protection of your privacy and personal information and health data is very important to us. The Service may store and otherwise process personal and health data. This information is confidential and are protected according to the Medical Ethics Code (law 3418/2005) and the General Data Protection Regulation 679/2016 and may only be processed and used in accordance with these Terms and applicable existing legislation. In our register descriptions available from the Service, you will find a detailed explanation of how we collect and use your personal information, which forms the HHG Customer Register.

The Medical Ethics Code and the existing legal framework define how and which information should be stored in healthcare service to arrange and deliver patient care. This information is made up of a personal record separate from the HHG Customer Record of Patient Data. For detailed information on how we treat patient information, see the Patient Registry Privacy Statement for the centrally maintained HHG service.

By using the Service, you give your consent to the collection of personal information about you and your use of the Service in accordance with our Privacy Policy ([undefined](undefined)), the Patient Register Privacy Statement, and applicable laws and regulations.

It is clarified that you can ask for the deletion of your personal data at any time and we have to comply with your written demand. In case of the health data, we have the legal obligation to maintain these records for a time limit of 20 years since the last visit to the application.

As described in more detail in the Patient Register Privacy Statement, your patient information is stored in a centralized registry on cloud technology maintained by the HHG Digital Clinic medical service and, subject to your consent, by the physicians involved in the centralized record keeping. All the necessary technical and organizational measures are in place.Your patient records are confidential. In connection with your treatment relationship, they may, with your consent, be used by a medical practitioner there. They will only be disclosed to others under the law or with your written permission and consent. You have the opportunity to review the information you stored in our register at any time via the application or upon written request via email or in person before the Hygeia S.A., which is the Data Controller. The right of inspection may be refused only in exceptional cases. Likewise, you have the right to request the correction of incorrect information in our register, or to revoke or limit your consent.

You are informed and agree that the professionals involved in your care will have total access to the information maintained on the Service, including any postings made by you. You will give your consent to the use of your information to healthcare professionals involved in HHG units who are involved in your treatment and who are affiliated with a centralized HHG-maintained registry.

Responsibility for the declared data

In addition to the terms set out in the Privacy Policy, you declare and agree not to give us false personal information or to create a user account for anyone other than yourself. You understand and agree that network and mobile services are not completely secure. You are responsible for the proper security of your devices, systems, identifiers and operations. Please be sure to provide appropriate protection for your identities associated with the Service. You are responsible for all use of the Service by your account.

Limitation of Liability

Use of the Service is at your own risk. You understand and agree that the Service will be provided to you on an “as is” basis.

The information and advice given to you by Healthcare Professionals through the Service should be used as a guide and as an initial recommendation for action or treatment. In all situations, the liability of the Service and of Healthcare Professionals is at most in accordance with the mandatory laws. The Healthcare Professionals providing the Service, our owners, directors, board members, employees, agents, shareholders, partners, advertisers or affiliates, or self-employed Healthcare Professionals are not responsible for any direct or consequential damages (including, but not limited to, injuries, personal injury, misrepresentation, loss of data, loss of use, misuse, loss of earnings) resulting from your use or inability to use the Service, the content on the Service, or any content and / or information you receive through the Service, whether we knew or we should have known that damage would be possible. In all cases, the liability of the HHG is at most in compliance with the mandatory provisions of Greek law.

The service is provided as an application platform through which health information is available and services provided as such. We cannot guarantee the accuracy, correctness, quality, coverage, appropriateness or reliability of any information contained in or accessed through the Service by the patient, nor do we guarantee the uninterrupted, timely or error-free operation of the Service. You may consult with your own physician regarding the suitability of any opinion or recommendation regarding your symptom or health.

Please note the limitations due to lack of physical examination and personal counseling for treatment events. The relationship with a doctor or other health care professional remains independent from the information available from the Service.

You acknowledge and agree that the Service or the Healthcare Professionals are not responsible for any decisions you make based on your use of the Service, such as your choice to seek or not seek healthcare or to take or not take a particular medicine based on information you receive through the Service. You agree to contact your doctor immediately if your condition changes or your symptoms get worse. It is always up to you to decide whether you are going for a personal physical examination, treatment or a medical examination. The sole responsibility for your use of, and non-use of, such Personal Service as well as, in general, your use of the Service.

It is very important to always remember that the information stored by the user on the Service as such is not necessarily subject to examination by the Healthcare Professional but must be specifically agreed upon with the Healthcare Professional providing the service, whereupon the user must ensure that the Healthcare Professional also processed the information to be treated. The user is responsible for the information provided and understands that the information provided does not replace the information received by a professional person through personal reception, measurement or examination.

Consultation can be provided by both HHG employees and the self-employed. The self-employed are not employed by the HHG and can pursue their activities either as a natural person or on behalf of the company. What is stated in these Terms and Conditions regarding self-employed persons also applies to such companies employing self-employed persons. Unless otherwise mandated by law, HHG is not responsible for the advice or other content of self-employed Healthcare Professionals. The practitioner and HHG act as separate parties to the contract with the client and the patient, and are directly responsible for their own service.

Applicable Law and Dispute Resolution

These Terms shall be governed by Greek law, except for conflict of laws provisions. Claims, actions or disputes arising out of or in connection with these Terms and in general this application will be settled in the courts of Athens.

Validity and Termination

We reserve the right to change or terminate the Service at any time, for any reason, without notice, and to terminate or suspend your access to the Service and / or your account. After termination, all terms of these Terms which by their very nature are intended to remain in effect despite the termination of the license remain in effect.
